PREAMBLE
When you visit our pop-up shops, temporary stores, event stands, visit or interact with us via the Website, our social media pages, by email or other digital means (www.hastko.com, hereinafter referred to as "the Website"), or when you view, purchase, and use our products online or in-store, we collect and process information relating to you, referred to as personal data.
In this notice, we explain what personal data we collect about you, why we collect it, and what we do with it. This notice applies both to consumers and small businesses, where indicated (collectively referred to as "you" or "Customers"), who purchase our clothing and other products or who otherwise interact with us online or offline.
Please note that this privacy notice may change. Any modifications will become effective once we publish the revised privacy notice on the Website.
1. WHO IS RESPONSIBLE FOR PROCESSING YOUR DATA?
MoGo Activewear (182, route du Bouchet, 74400 Chamonix-Mont-Blanc, France) is responsible for this privacy notice. This legal entity is referred to as "we", "us", or "our" throughout this document. You can contact us at the address indicated at the end of this privacy policy.
2. WHAT INFORMATION DO WE COLLECT AND WHY?
2.1. TO MANAGE PURCHASES AND PROVIDE SERVICES
2.1.1. Orders, in-store purchases, and accounts
When purchasing an item on the Website, we collect your name and your company's name (if you're a small business), full address and/or billing address if different, email address, ordered and returned items, delivery information, billing information, and other data related to fulfilling your order. We also collect data regarding the use of your vouchers (e.g., validity and amount) or gift cards. Additionally, we collect certain data you choose to provide in optional fields, such as your date of birth and phone number.
We use these data to conclude, execute, and manage your purchase and order. Please note some information may be mandatory. If you do not provide your name and delivery address, we will not be able to deliver your items.
During checkout, you'll have the option to create a personal HÄSTKO account. If you do so, you'll be asked to create a personal password, provide your birthdate, and opt-in for marketing communications.
In our stores, depending on whether you're a consumer or not, we collect your name, address, and other relevant personal information necessary to comply with local fiscal and legal requirements. We may require this information to refund you or issue a VAT receipt. These data are collected in-store via our point-of-sale terminal.
2.1.2. Customer service and other requests
We collect data to answer your questions by phone, mail, email, or online through a chatbot or online form. In these cases, we only ask for data necessary to process your request (to manage our contractual relationship with you and/or comply with a legal obligation). For example, if you contact us regarding a product return, we may ask you the date and place of your purchase or information about your decision to return the item.
When you interact with chatbots, we record your responses, interaction patterns, and related device information. Depending on the chatbot platform and permissions, device data may include IP address, social media pseudonym, time zone, country, and GPS location. The chatbot platform provider may also collect these data. For example, if the chatbot is provided via Facebook, Facebook may also collect your user data. We also collect additional details concerning the response to your query, including conversation content.
We process these data either to manage our contractual relationship if your query relates to an order or due to our legitimate interest in assisting you and improving our services.
2.1.3. Changes to terms, conditions, or notices
By law, we must inform you of terms and conditions applicable to our relationship (and any modifications). To meet these legal obligations, we may use your contact details, such as your email address, to inform you.
2.1.4. Checks for fraudulent credit card use or chargeback abuse
If paying by credit card, we'll perform credit checks to ensure your personal data are not associated with fraudulent card use or chargeback abuse. For this purpose, our payment service provider uses your name and bank details. We do not collect payment instrument details ourselves (e.g., credit card information). These are processed exclusively by our payment service provider and payment instrument suppliers under strict security assurances. These checks help protect our legitimate business interests against fraud and financial losses or to comply with legal obligations.
2.2. TO MAINTAIN OUR RELATIONSHIP WITH YOU
2.2.1. Newsletters, promotional communications, or clickable links in an email
When you consent or when we have a legitimate interest to do so, we collect your email address and/or your mobile phone number and/or your postal address to send you our newsletter and other commercial messages. Additionally, we will keep a history of the emails and SMS messages we send you and will record what you do with them (for example, whether you open them or click on their content). Please note that you may unsubscribe at any time using the "unsubscribe" or "opt out" button, or by asking us to do so by contacting us using the details provided below or in the relevant commercial message.
2.2.2. Personalized experience and improving the online experience
When you visit the Site, we place cookies, pixels, and other digital tools with similar functionalities ("cookies") on your browser or device to better understand you, personalize your experience with us, and better target communications and marketing to you.

2.2.3. Personalized targeted advertising
Your online and in-store purchase history, your behavior on the Site (pages visited, links clicked), and your interaction with chatbots allow us to create and maintain your personal digital marketing profile to ensure that we show you only advertisements most likely to suit your personal tastes. This is known as targeted advertising. The more successful this targeted advertising is, the higher the satisfaction of our (potential) Customers.
To be able to show you targeted ads, we may also link your data profile to Customers with a similar profile.
If your digital marketing profile falls within such a segment, the advertisements you receive from us will likely be tailored to the interests of the segment in which we have placed you on Facebook, Google properties, so-called affiliate online properties, as well as on other sites and online and offline materials, as part of targeted advertising.
We may also use the data for retargeting by showing you targeted ads on a third-party Site related to an event on the Site, for example, a specific purchase that was abandoned.
Furthermore, Facebook, Google, and other online players may independently record your use of our ads. Please read the privacy policies of these third parties as we are not responsible for the personal data they process for their own purposes.
You may ask us to delete your digital marketing profile by sending us an email to the address provided below.
We will only use your data for targeted advertising if you have consented to the placement of cookies and the collection of personal data via these cookies.
2.2.4. Participation in a sweepstake, contest, or promotion
We may offer you the opportunity to participate in a sweepstake, contest, or other promotion. Some of these promotions have additional rules that provide information on how we will use and disclose your personal data.
In principle, we obtain your personal data directly from you. However, in some cases, we receive personal data, such as your purchasing preferences and activities, through publicly accessible databases, our digital marketing activities, or from our partners when they share this information with us.
2.2.5. Social media listening
If you actively communicate about us or our brands on social media, we collect a copy of your communications. For example, if you use #hastko when talking about one of our items, we will keep a copy of the post and may use it to increase awareness of our brands. Please note that any information you post or disclose through these services will become public and may be accessible to other users and the general public.
Similarly, if you disclose personal data about other people to us or our service providers, you declare that you have the authority to do so and to allow us to use the personal data in accordance with this privacy notice. If you choose to connect your social media account to your HASTKO account (when this feature is available), you will share with us certain personal data from your social media account; for example, your name, email address, photo, social media contact list, and any other information that is accessible or that you make accessible when you connect your social media account to your HASTKO account. We will carry out these activities to manage our contractual relationship with you, with your consent, or when we have a legitimate interest.
2.2.6. General conditions for SMS marketing
We use a text messaging platform, which is subject to the following general conditions. By subscribing to our SMS marketing and notifications, you agree to these conditions.
By entering your phone number at checkout and initiating a purchase, subscribing via our subscription form, or via a keyword, you agree that we may send you SMS notifications (for your order, including abandoned cart reminders) and SMS marketing offers. You acknowledge that consent is not a condition of any purchase.
Your phone number, name, and purchase information will be shared with our SMS platform "SMSBump Inc", a company of the European Union based in Sofia, Bulgaria, EU. This data will be used to send you targeted marketing messages and notifications. When SMS messages are sent, your phone number will be transmitted to an SMS operator to ensure delivery.
If you wish to unsubscribe from receiving SMS marketing messages and notifications, reply STOP to any mobile message sent by us or use the unsubscribe link provided in one of our messages. You understand and agree that alternative opt-out methods, such as using alternative words or requests, will not be considered a reasonable means of opting out. Message and data rates may apply.
For any questions, please text "HELP" to the number that sent you the messages. You may also contact us for more information. If you wish to unsubscribe, please follow the procedures above.
2.3. TO IMPROVE OUR SERVICES AND PRODUCTS
We process your personal data to identify usage trends and personalized service content (e.g., items, size recommendations) on the Site. The information we obtain is used to further improve our services and products, for example, to help us create and design our new collection, or to make improvements to existing collections to better meet your expectations.
For example, if you actively communicate about us or our brands on social media, or if you interact with our chatbot or customer service, we may use your feedback to improve our services and products. We will carry out this activity when we have a legitimate interest.
2.4. AS PART OF A BUSINESS TRANSACTION
We may share your personal data with a third party as part of a restructuring, merger, sale, joint venture, assignment, transfer, or other disposition of all or part of our business, assets, or shares (including in the context of bankruptcy proceedings or similar processes). Such third parties may include, for example, an acquiring entity and its advisors. We will carry out this activity when we have a legitimate interest.
2.5. TO MANAGE AND IMPROVE THE FUNCTIONALITY OF THE SITE
When you visit the Site, we place cookies, pixels, and other digital tools with similar functionality (“cookies”) on your browser or device to allow us to improve the design and functionality of our Site as well as the responsiveness of our chatbots, and to enable us to ensure the technical and functional management of the Site (including information security), for example by identifying low-latency areas of the Site. We carry out this activity when we have a legitimate interest.
2.7. TO ACHIEVE OUR OTHER BUSINESS OBJECTIVES
If necessary, we may use your personal data to manage security and fraud issues, for example, to detect and prevent cyberattacks or attempts at identity theft. In addition, we may use your personal data to protect our rights and defend ourselves in the event of legal proceedings, as well as to comply with legal and regulatory obligations, such as requests made by public and governmental authorities. We carry out these activities to fulfill a legal obligation or because we have a legitimate interest.
3. USE BY MINORS
Please note that the Site is not intended for children under sixteen (16) years of age. We ask that you do not post comments or contributions from children under this age.
4. WHO HAS ACCESS TO YOUR PERSONAL DATA?
Your personal data is accessible to our employees to the extent that such access is necessary for them to perform their work for us. In addition, we disclose personal data to:
• Our third-party service providers, who facilitate the administration of the Site, marketing initiatives (including contests, sweepstakes, and similar promotions), and other business needs, such as data hosting, data analysis, security and information technology, provision of related infrastructure, customer service, auditing, payment service providers, marketing service providers, and other business purposes.
• Other individuals with whom you choose to share your personal data, including, for example, third parties who are our partners or with whom we interact, including marketing and social media partners.
• Public authorities, judicial and police authorities, tax authorities, and other authorities with investigative powers or public authority functions in accordance with applicable law.
5. HOW LONG DO WE KEEP YOUR DATA?
We retain your personal data throughout your active interaction with us. Your interaction with us is no longer considered active if, during a period of two (2) consecutive years, you have not purchased any item from us or visited any of the Site. After this two (2) year period, we will only retain specific personal data that must be kept (i) in light of the purposes for which they were obtained, (ii) if they are required to comply with a legal obligation, or (iii) if necessary, to protect our rights and legal position.
If you have chosen to receive marketing communications, we will continue to use your email address for this purpose until you choose to stop receiving such communications.
6. DO WE TRANSFER YOUR DATA OUTSIDE THE EEA?
Yes, your personal data may be transferred outside the European Economic Area (“EEA”), for example, to countries where we have facilities or where we have service providers. Some countries outside the EEA are recognized by the European Commission as providing an adequate level of data protection in line with EEA standards (the full list of such countries is available here). 8. COOKIES
When you visit our Site or use a mobile application, we place one or more cookies on your device to collect information from your computer, mobile device, or other device.

8.1. WHY DO WE USE COOKIES?

We collect information about how our consumers respond to our products, our brand, and our advertisements. This information is collected from different sources available to us offline, online, and via mobile, for example, when you visit our Site. In addition, we collect information gathered by others. This information helps our marketing teams identify and define relevant online audience segments to run marketing campaigns that better target them, within and outside the digital channels of HÄSTKO. If your digital marketing profile falls within such a segment, the advertisements you receive from us will likely be tailored to the interests of the segment in which we have placed you on Facebook, Google properties, so-called affiliate online properties, as well as on other sites and online and offline materials, as part of targeted advertising.
We may also use the data for retargeting purposes by showing you targeted advertising on a third-party site related to an event on our Site, such as a specific purchase that was abandoned.
Furthermore, Facebook, Google, and other online actors may independently record your use of our advertisements. Please read the privacy policies of these third parties as we are not responsible for the personal data they process for their own purposes.
8.2. HOW CAN I MAKE CHOICES REGARDING COOKIES AND MY PRIVACY?
On our Site, you can set your cookie preferences by clicking on the “settings” link located in the cookie banner or, if you wish to change consent you previously provided, you can access your preferences via the “settings” button here. When the next “settings” screen is displayed, you can indicate that you withdraw your consent by unchecking the boxes related to analytical cookies and social media and advertising cookies. Naturally, we prefer that you do not do this, as we believe these cookies allow you to have the best possible experience on the Site and help us avoid showing you ads that are not relevant to you.
In accordance with the law of January 6, 1978 as amended by the law of August 6, 2004, the Customer has the right to access and rectify personal data concerning them contained in the files of MoGo Activewear.
